Abstract:The author provides an in-depth discussion of the scope of control that digital rights management (DRM) can assert over intellectural property assets. The role of fair use and the activities that rely on fair use are explained. He also revisits the purpose of copyright law, indicating that it represents a bargain between the public and copyright owners. The author concludes that DRM threatens to undermine fair use in its efforts to control infringement.
